General Provisions

1. The subject of these Terms and Conditions is the regulation of the sales conditions and the operation of the Online Store. In accordance with Art. 384 of the Civil Code, these Terms and Conditions form part of the agreement concluded with the Seller.

2. Placing an effective Order is possible after accepting the provisions of these Terms and Conditions.

3. The Online Store sells goods via the Internet, through the store system located on the website www.skarpetoholik.pl

4. The owner of the online store registered at www.skarpetoholik.pl is LT Crafts sp. z o.o., ul. Fabryczna 25E, 90-341 Łódź, NIP 7282891685, hereinafter referred to as the Seller.

5. The Buyer may be any natural person, legal person, or organizational unit without legal personality, using their own e-mail account and having the legal capacity to perform legal actions in accordance with the law.

6. The Consumer shall be understood as a natural person purchasing products in the Online Store, within the meaning of Art. 221 of the Civil Code.

7. The provisions of the Act of 30 May 2014 on consumer rights do not apply to entities other than Consumers.

8. The parties to the agreement exclude the Seller's liability under the statutory warranty (rękojmia) for physical and legal defects of the product, in relation to persons and entities that are not Consumers.

9. The information on the Seller's websites does not constitute an offer within the meaning of Art. 66 of the Civil Code; it constitutes an invitation to conclude an agreement within the meaning of Art. 71 of the Civil Code.

10. The Seller presents digital photos of the offered products. Furthermore, the Seller makes every effort to ensure that the presented photos are of the highest quality and reflect the actual condition and colors of the presented products to the greatest extent. The arrangement of patterns on the products in reality may slightly differ from the designs presented in the online store.

11. Prices in the Seller's Online Store are given in Polish zlotys (PLN) and are gross values (they include all their components, including applicable VAT).

12. The Seller reserves the right to change the prices of products in the product catalog, introduce new products to the Online Store and remove unavailable products, conduct and cancel promotional campaigns on the Seller's pages, and introduce modifications to them.

Orders

1. Orders are accepted through the store system on the website www.skarpetoholik.pl. When placing an order, the required fields must be correctly filled in accordance with the order form instructions.

2. A distance sales agreement between the Seller and the Buyer is concluded after the correct completion of the purchase procedure defined in the order form of the store system on the website www.skarpetoholik.pl.

3. The Seller's obligation is to provide the Buyer with goods free from defects. The Consumer's obligations under the concluded sales agreement end upon receipt of the goods and payment of the full price, in accordance with these Terms and Conditions, subject to the Consumer's obligations in the event of a complaint or withdrawal from the agreement.

4. If the ordered product is unavailable, the Buyer is informed of this fact by the Seller within 14 working days and decides on how to proceed with the remainder of the order (partial fulfillment, extending the waiting time for the missing product, replacing the missing product with another, or canceling the entire order and refunding the money for the ordered products).

5. The goods covered by the order are delivered to the Buyer by the Seller along with a sales document, i.e., a fiscal receipt or a personal invoice, if the Buyer requested one when placing the order and provided the necessary data to issue it, and a written statement from the Seller about the possibility of returning the goods.

6. Payment for the goods and the cost of delivery are made through payment operators: http://montonio.pl, the https://www.paypal.com system, or by bank transfer.

7. Delivery of goods takes place in the manner specified in the order. Shipments are delivered by the courier company InPost or DPD. The shipment is sent within 7 working days of the payment being credited to the Seller's bank account.

8. Delivery of goods purchased in the Polish-language version of the Store, in PLN currency, is possible only within the territory of the Republic of Poland.

Complaints about a purchased product

1. The Seller is liable to the Consumer if the sold item has a physical or legal defect (statutory warranty - rękojmia).

2. The Seller is released from liability under the statutory warranty if: a. The Consumer knew about the defect at the time of concluding the agreement; b. The Seller is not liable to the Consumer for the sold item not having the properties resulting from public assurances if the Seller did not know these assurances nor, judging reasonably, could have known them, or they could not have influenced the Consumer's decision to conclude the sales agreement, or if their content was rectified before the conclusion of the sales agreement.

3. If the sold item has a defect, the Consumer may submit a statement on price reduction or withdrawal from the agreement, unless the Seller immediately and without undue inconvenience to the Consumer replaces the defective item with a defect-free one or removes the defect. This limitation does not apply if the item has already been replaced or repaired by the Seller, or the Seller has not fulfilled the obligation to replace the item with a defect-free one or remove the defect.

4. The Consumer may demand replacement of the item with a defect-free one instead of the defect removal proposed by the Seller, unless bringing the item into conformity with the agreement in the manner chosen by the Consumer is impossible or would require excessive costs compared to the method proposed by the Seller. When assessing the excessiveness of costs, the value of the defect-free item, the type and significance of the defect found, as well as the inconvenience to which the Consumer would be exposed by another method of satisfaction, are taken into account.

5. The reduced price should be in such proportion to the price resulting from the agreement as the value of the defective item remains to the value of the defect-free item.

6. The Consumer may not withdraw from the agreement if the defect is insignificant. If only some of the sold items are defective, the Consumer's right to withdraw from the agreement is limited to the defective items.

7. When filing a complaint, the Consumer should send a scan of a hand-signed complaint statement and bank transfer details to the e-mail address: sklep@skarpetoholik.pl, and then send the purchased goods to the following address: SKARPETOHOLIK ul. Fabryczna 25E, 90-341 Łódź, tel. +48570048333 with the note "REKLAMACJA" (COMPLAINT).

8. The Seller shall refund the Consumer the costs associated with sending the non-conforming goods, immediately after considering and accepting the Consumer's claims under the statutory warranty for defects.

9. If it is not possible to repair or replace the goods with a new one, the Seller will inform the Consumer about a possible exchange for other goods with identical parameters.

10. Upon receipt of the shipment, the Consumer should check it in the presence of the deliverer (courier) and, in the event of mechanical damage occurring during transport, draw up a report signed by the Consumer and the deliverer.

Return and exchange of a purchased product

1. In accordance with Art. 27 of the Act of 30 May 2014 on consumer rights, the Consumer has the right to withdraw from the agreement within 14 days from the date of product delivery without giving a reason.

2. When returning goods, the Buyer should complete the withdrawal form (link) or send a clear statement of withdrawal from the agreement to the Seller at sklep@skarpetoholik.pl and send the goods to the following contact details: SKARPETOHOLIK ul. Fabryczna 25E, 90-341 Łódź, tel. +48570048333 with the note "ZWROT" (RETURN).

3. In the event of withdrawal from the agreement, on the basis specified in pt. 1, both the Seller and the Consumer are obliged to return everything they received from the other party under the concluded agreement.

4. The Consumer bears the direct costs of returning the product. In case of failure to collect the shipment, the customer bears the cost of the return logistics service, referred to in the SHIPPING and RETURNS tab.

5. In the case of full withdrawal from this agreement (return of all purchased products), the Seller shall refund all payments received from the Consumer no later than 14 days from the day on which the Seller was informed (via the form) of the Consumer's decision to exercise the right of withdrawal. The refund (including the cheapest shipping option) will be made using the same payment method that was used by the Consumer in the original transaction.

6. The Consumer, with the Seller's consent, may exchange the product for another within 14 days from the date of receipt. In such a case, the Buyer should contact the Seller via e-mail: sklep@skarpetoholik.pl. In this situation, the provisions of these Terms and Conditions shall apply accordingly, and in particular those contained in § 3 pt. 2.

7. The Consumer is responsible for any reduction in the value of the item resulting from using it in a way other than what was necessary to establish the nature, characteristics, and functioning of the item.

8. The right to withdraw from the agreement does not apply to the Consumer in relation to agreements:

a) for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the start of the provision that after the entrepreneur has completed the provision, he will lose the right to withdraw from the agreement;

b) in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control, and which may occur before the deadline for withdrawing from the agreement;

c) in which the subject of the provision is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy his individualized needs;

d) in which the subject of the provision is an item that spoils quickly or has a short shelf life;

e) in which the subject of the provision is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;

f) in which the subject of the provision are items that, after delivery, due to their nature, are inextricably linked with other items;

g) in which the subject of the provision are alcoholic beverages, the price of which was agreed upon at the conclusion of the sales agreement, and the delivery of which can only take place after 30 days and whose value depends on market fluctuations over which the entrepreneur has no control;

h) in which the consumer expressly requested that the entrepreneur come to him for urgent repair or maintenance; if the entrepreneur provides additional services other than those requested by the consumer, or delivers items other than spare parts necessary for the repair or maintenance, the consumer has the right to withdraw from the agreement in relation to the additional services or items;

i) in which the subject of the provision are sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery;

j) for the supply of newspapers, periodicals, or magazines, except for a subscription agreement;

k) concluded through a public auction;

l) for the provision of services in the field of accommodation, other than for residential purposes, transport of goods, car rental, gastronomy, services related to leisure, entertainment, sports, or cultural events, if the agreement specifies the day or period of service provision;

m) for the supply of digital content that is not stored on a tangible medium, if the performance of the provision began with the express consent of the consumer before the deadline for withdrawing from the agreement and after the entrepreneur informed him about the loss of the right to withdraw from the agreement.

Personal Data Protection

1. Providing personal data by the Buyer is voluntary, however, its absence makes it impossible to complete the order. By making a purchase, the Buyer agrees to the collection, processing, and use of personal data by the Seller for the purpose and scope necessary to fulfill the order (i.e., to deliver the shipment to the Buyer and make settlements).

3. The data will be processed in compliance with all security requirements, which are defined in Art. 4 pt 7 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR") and in the implementing provisions issued on its basis.

4. The Buyer has the right to free access (insight) to their personal data, the right to correct them, and the right to request the cessation of their processing and their removal from the database, which should be reported in writing to the seller at the e-mail address: sklep@skarpetoholik.pl.
